Mediation is an excellent
tool for resolving the disputes that naturally arise after someone becomes
incapacitated or dies. The people around an incapacitated family member
or friend are often faced with hard choices and these issues can create
conflict within a family or community. Alternative
conflict resolution is a powerful tool for resolving
these conflicts and it provides a structured forum for discussing alternatives.
These sessions often provide “win-win” solutions to complicated
and stressful disagreements.
Such conflicts often arise before death, often after the stress and
tensiom has built up over long periods of time. It takes an experienced
mediator/facilitator to guide parties through the conflict using a process
that explors possible solutions. The effort is usually well worth the
time and expense as it allows the parties to discover a solution that
works for all involved. Mediation requires voluntary cooperation and
a decision-making process that allows each party a say in the outcome.
